The #FindYourZen GIVEAWAY (“Contest”) IS OPEN TO RESIDENTS OF Singapore, Australia, Hong Kong, Malaysia, USA, Canada, United Kingdom, Ireland, Austria, Belgium, Luxembourg, Germany, Italy, France, Spain, Portugal, Poland, Czech Republic, Slovak Republic, Slovenia, Estonia, Hungary, Denmark, Sweden, Norway, Netherlands, Greece, Cyprus, Malta, and Switzerland except where prohibited by the applicable federal, state and local laws and regulations. The Contest is sponsored by Creative Labs Pte. Ltd, #03-01, Creative Resource, Singapore 609921(“Creative”).
The Contest is offered only electronically via the Internet.
2.1 Person Eligible to Participate
(i) It is open to all natural persons age 18 and older, who are residents of a country in Singapore, Australia, Hong Kong, Malaysia, USA, Canada, United Kingdom, Ireland, Austria, Belgium, Luxembourg, Germany, Italy, France, Spain, Portugal, Poland, Czech Republic, Slovak Republic, Slovenia, Estonia, Hungary, Denmark, Sweden, Norway, Netherlands, Greece, Cyprus, Malta, and Switzerland for the duration of the Contest, and who have Internet access as of the day before the Contest begins.
(ii) The Contest is only open for the time period as expressly stated by Creative (“Contest Period”).
2.2 Persons Not Eligible to Participate
Employees, officers and directors of Creative, its affiliates, subsidiaries, advertising, promotion and fulfillment agencies, their immediate family members and persons living in the same household are not eligible to participate in the Contest. No purchase necessary. Void in countries where such Contests are prohibited. All applicable federal, provincial, state and local laws and regulations apply.
3. HOW TO ENTER
3.1 You may enter the Contest by accessing the Contest URL at www.creative.com/campaign/findyourzen (“Contest URL”) and following the instructions to participate. This shall include filling in a form with your name and email details (as required) and submitting it electronically via the Contest URL.
3.2 Only one entry per person is permitted.
3.3 In order to be eligible for a particular drawing, electronic entries must be received by Creative’s server no later than 2359 Hours on the last day of the Contest Period (from 17 May 2022 to 7 June 2022), in accordance with Creative’s server time. All entries thereafter become the exclusive property of Creative, and will not be acknowledged or returned.
3.4 You are fully responsible for ensuring the accuracy and veracity of any material and/or information that you provide and you shall undertake that any material you provide, does not infringe or violate any third-party intellectual property including copyrights, trademarks or trade secrets. You also agree that by submitting an entry for the Contest, you surrender your intellectual property rights, copyrights and any other rights you may have in and to the material and/or information submitted and further agree that Creative at its sole discretion is entitled to use the material and/or information for any purpose and in any manner it deems fit.
4. PRIZE DETAILS
Each participant stands a chance to win a pair of Creative Zen Hybrid Headphones. Creative expressly reserves all rights to replace or substitute any stated prizes with other prizes of generally similar value in the event of any prize unavailability. All such prizes are strictly not refundable nor transferable. No cash alternatives or refunds will be offered in exchange, under any circumstances whatsoever. Winners hereby undertake to accept whatever prizes that may be offered by Creative for its prize category. Creative’s decision shall in all respects, be final. All federal, provincial, state and/or local taxes and any import/export duties or customs fees, where applicable, are the sole responsibility of the prize winners.
5. SELECTION OF WINNER(S)
5.1 One Hundred (100) winner(s) will be selected randomly from all duly completed and eligible entries received, to be held on or about one (1) week following the close of the Contest Period.
5.2 All of Creative’s decisions are final and binding. Odds of winning will depend on the total number of eligible and correct entries received. Winner(s) will be notified by email at Creative’s discretion within fourteen (14) days of the drawing. Winner(s) will strictly have seven (7) days from the date of notification to accept the prize by email and reply with details of their contact details and shipping information.
5.3 Creative is not responsible whatsoever for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify winner(s). If selected winner(s) cannot be contacted, is/are ineligible, fails to claim a prize, or fails to return the completed and executed declaration, consent and releases or other documents as may be required in a timely manner, alternative winner will be selected. In the event of a dispute regarding who submitted an online entry, the entry will be deemed submitted by the authorized account holder of the email account.
5.4 By acknowledging their win and thereafter accepting and/or using prize, Winners agree to the use of the full name, voice, and/or likeness of such winners for the purpose of advertising, publicity, trade or promotion of Creative and/or products, worldwide and without further compensation, unless prohibited by law. Creative reserves the right to post the names and countries of the Winner(s) on the Internet.
6.1 Creative expressly reserves the right at its sole discretion to forthwith disqualify any individual who acts as follows:
(i) violates any of these Terms and Conditions;
(ii) undermines, hacks or tampers with any entry or selection of winners process and/or the operation of the Contest or any part thereof; or
(iii) acts in an abusive, fraudulent or disruptive manner,
PROVIDED always that Creative’s failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.
6.2 By entering, each entrant agrees to abide by and be bound by these Terms and Conditions and the decisions of Creative, which shall be final in all respects relating to the Contest, including without limitation the interpretation of these rules. Creative, its agents and representatives of Creative, its directors, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors shall not under any circumstance be responsible for and shall not be liable for:
(i) late, lost, delayed, damaged, misdirected, incomplete, illegible, unintelligible entries;
(ii) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, data corruption, data loss, viruses, bugs, or difficulties of failures of any kind;
(iii) failed, incomplete, garbled, or delayed computer transmissions;
(iv) any condition caused by events beyond the control of Creative that may cause the Contest to be disrupted or corrupted;
(v) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Contest; or
(vi) any printing or typographical errors in any materials associated with the Contest. Creative reserves the right, in its sole discretion, to suspend or cancel Contest in whole or in part at any time if a computer, virus, bug or other technical problem corrupts the administration, security, or proper play of the Contest.
Creative reserves all rights in its sole discretion, to amend or modify the rules, make prize substitutions and/or cancel this Contest without any notice.
ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, CREATIVE RESERVES ALL RIGHTS TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.
By participating in the Contest, each entrant hereby agree that Creative has not made any representations or warranties (whether express or implied) of any sort in respect of and including but not limited to the Contest and/or the prizes or the winners and each entrant hereby expressly releases and holds Creative, its employees, officers, directors, shareholders, agents, representatives of Creative, its affiliates, subsidiaries, advertising, promotion and fulfillment agencies, and legal advisors, harmless from any and all losses, costs, expenses, damages, rights, claims and actions of any kind in connection with or associated to the Contest or resulting from breach of these Terms and Conditions by You the entrant, acceptance, possession, and/or use of any prize, including without limitation, personal injury, death and property damage and claims based on publicity rights, defamation, or invasion of privacy.
Creative shall not be liable under any circumstances including for any sort for any damages and/or loss or any inconvenience caused by viruses and/or other malicious code originating or contracted from this website, or arising from any of the prizes, its use thereof or otherwise. It is solely your responsibility to ensure that your computer/device/table runs on up-to-date anti-virus software at all times and to check regularly for viruses and/or other malicious code. Creative will use reasonable endeavours to ensure that this website does not contain or spread any viruses or other malicious code.
9. NO LIABILITY FOR DAMAGES
IN NO EVENT SHALL CREATIVE, ITS AFFILIATES, SUBSIDIARIES, INCLUDING ITS DIRECTORS, REPRESENTATIVES, EMPLOYEES OR AGENTS, BE LIABLE WHATSOEVER FOR ANY CLAIM, COST OR DAMAGES INCLUDING ANY CONSEQUENTIAL, INCIDENTAL, INDIRECT, PUNITIVE OR SPECIAL DAMAGES OF ANY NATURE WHATSOEVER, INCLUDING WITHOUT LIMITATION ANY DAMAGES ARISING OUT OF OR IN CONNECTION WITH ANY MALFUNCTIONS, DELAYS, LOSS OF DATA, LOSS OF PROFIT, INTERRUPTION OF SERVICE OR LOSS OF BUSINESS OR ANTICIPATORY PROFITS, ARISING OUT OF THE CONTEST HEREIN, YOUR PARTICIPATION IN THE CONTEST, YOUR USE OF AND/OR INABILITY TO USE THE PRIZE EVEN IF CREATIVE HAS BEEN APPRISED OF THE LIKELIHOOD OF SUCH DAMAGES OCCURRING.
As a condition of participating in this Contest, participant hereby agrees that all disputes shall first be amicably resolved within thirty (30) days from the day the dispute arose and that any and all disputes which cannot be resolved amicably between the parties, and causes of action arising out of or connection with this Contest, shall thereafter be resolved individually, without resort to any form of class action, exclusively, before a court located in the Republic of Singapore, which court shall apply the laws of the Republic of Singapore.
11. EXCLUSION OF THIRD-PARTY RIGHTS
Any person or party who is not an eligible entrant to the Contest referred to herein, shall have no rights whatsoever to enforce any term or provision (or any part thereof) of the Terms and Conditions herein.

This Contest herein is in no way sponsored, endorsed or administered by Facebook and/or Instagram. By taking part in this Contest, you agree to release Facebook and/or Instagram from all liability whatsoever.
